Terms of Use

This English text is a reference translation. The Japanese text above is the one that applies.

Enacted: October 5, 2026 · Last revised: October 9, 2026

These Terms were revised on October 9, 2026. Main changes: use by minors (Article 3), refunds (Article 10), limitation of liability (Article 13), new articles on anti-social forces, assignment, severability and language, and the procedure for changing these Terms (Article 18).

Article 1 (Scope)

  1. These Terms of Use (the “Terms”) set out the conditions for using the virtual aquarium “aqua” (the “Service”) provided by VirtualCross (“we” or “us”). The Service runs in a web browser and in the iOS and Android apps.
  2. Users use the Service on the condition that they agree to these Terms, and are deemed to have agreed to them when they use the Service.
  3. Prices, help pages and other individual provisions we post on the Service (“Individual Provisions”) form part of these Terms. Where they conflict with these Terms, the Individual Provisions prevail.

Article 2 (Accounts)

  1. You can create an account for the Service by signing in with a Google or an Apple account. When you are signed in, your tickets are kept in your account and can be used from other devices. You can also buy and use a ticket without signing in (Article 7).
  2. You are responsible for managing your account and must not let a third party use it.
  3. We are not liable for damage you suffer because a third party used your account, unless the cause is attributable to us.
  4. You can delete your account at any time from “Delete account” in the ticket holder. This also deletes the record of your tickets and cannot be undone.

Article 3 (Use by minors)

  1. Persons under 13 years of age may not use the Service.
  2. If you are a minor, use the Service (including buying tickets) with the consent of a parent or other legal guardian.
  3. A minor who uses deception to be believed to have legal capacity, such as falsely claiming to have a guardian’s consent or misstating their age, may not rescind a contract relating to the Service.

Article 4 (What you register)

  1. The name and look of the avatar you register (“Registered Content”) are shown to the users in the same room.
  2. You grant us a free, non-exclusive licence to use (including to copy, transmit and display) Registered Content to the extent needed to provide, maintain and improve the Service.
  3. You warrant that you hold the necessary rights in your Registered Content or have the right holder’s permission.
  4. We have no duty to monitor Registered Content, but may take the measures in Articles 5 and 6 where we judge that they apply.

Article 5 (Prohibited acts)

In using the Service, you must not do any of the following.

  1. Acts that violate laws or public order and morals
  2. Criminal acts, or acts that encourage them
  3. Infringing the copyright, trademark, portrait rights, privacy or other rights or interests of others
  4. Impersonating others, or creating the false impression of a connection with us or any other organisation
  5. Defaming others, or promoting discrimination
  6. Registering or sending obscene, violent or otherwise offensive content
  7. Registering or sending another person’s personal information without their consent
  8. Using the Service for fraud, solicitation, spam or any other purpose that deceives or troubles others
  9. Putting an excessive load on the Service’s servers or network, accessing them without authorisation, or accessing or collecting information in bulk by automated means
  10. Deliberately exploiting faults in the Service, or analysing the Service by reverse engineering or similar means
  11. Reselling tickets or invitations, or distributing them for profit
  12. Copying or redistributing the Service’s content (3D models, images, text, sound and so on) without our permission
  13. Using the Service for commercial purposes in ways the Service is not intended for, without our permission
  14. Providing benefits to anti-social forces
  15. Any other act that we reasonably judge to be comparable to the above

Article 6 (Suspension and other measures)

  1. If we judge that any of the following applies to you, we may, without prior notice, delete your Registered Content, remove you from a room, suspend your use of all or part of the Service, delete your account, or take any other measure we consider necessary.
    1. You have violated these Terms
    2. Your registered information is false
    3. You have violated Article 15 (Exclusion of anti-social forces)
    4. For a comparable reason, we reasonably judge that it is not appropriate to let you continue using the Service
  2. We are not obliged to disclose the reasons for a measure under the preceding paragraph.
  3. Where a measure under paragraph 1 was taken for a reason attributable to you, we do not refund fees already received.
  4. If you find content that violates these Terms, please contact us through the channel in Article 19.

Article 7 (Tickets)

  1. You need a ticket to enter the hall (unless you were invited under Article 8). The contents, price and payment methods of tickets are as shown in the Individual Provisions (the purchase screen). The price shown is the amount you pay. On the web, a single ticket costs 200 yen. In the iOS and Android apps, the price is the one shown in the App Store or on Google Play (250 yen for a single ticket in Japan). The year pass is not on sale yet.
  2. On the web, fees are paid by credit card or other means through the payment service of Stripe, Inc. We do not receive card numbers.
  3. In-app purchases in the iOS and Android apps are paid through the payment means provided by Apple Inc. or Google LLC, and payment, receipts and refunds follow each company’s rules. We do not receive payment details such as card numbers.
  4. A single ticket is valid on the day of purchase (Japan time) and stops working when the date changes. A ticket whose validity has ended cannot be used. A ticket’s design is picked at random when it is issued and cannot be chosen.
  5. A ticket bought without signing in works only on the device (browser or app) it was bought on. If you sign in on that device, the ticket is carried over to your account. To use a ticket bought in an app on another device, sign in before buying it.

Article 8 (Inviting friends)

  1. A user holding a ticket for the day can open a room and invite friends. A room holds up to four people, including the user who opened it.
  2. Invited users may enter the hall free of charge for as long as the room lasts.
  3. A room ends at most two hours after it is opened. A room can be opened twice a day (a room nobody joined does not count).
  4. If the user who invited them leaves the hall, invited users have to leave five minutes later.

Article 9 (Intellectual property)

Rights in the Service’s content (3D models, images, text, sound, programs and so on) belong to us or to their rightful owners. Sources of the animal call recordings are given at the end of each guide.

Article 10 (Refunds)

  1. Except where the law or these Terms provide otherwise, we do not refund fees we have received.
  2. If a fault in the Service prevents you from using a ticket, please contact us through the channel in Article 19.
  3. Refunds for in-app purchases follow Apple’s or Google’s procedures, as set out in Article 7 (request them through “Report a Problem” for the App Store, or your order history on Google Play).
  4. Where we make a refund, it is returned through Stripe to the payment method used (such as the credit card).

Article 11 (Changes, interruptions and closure of the Service)

  1. We may change the contents of the Service. Changes that significantly affect users, such as reducing what a ticket gives access to, will be announced on the Service in advance.
  2. We may interrupt all or part of the Service without prior notice in any of the following cases.
    1. Maintenance, inspection or updates
    2. Natural disaster, power failure, communication failure, system failure or other force majeure that makes provision difficult
    3. Suspension or change of an external service the Service relies on (cloud, payment, sign-in and so on)
    4. Any comparable case in which we reasonably judge an interruption necessary
  3. We may close all or part of the Service by announcing it on the Service at least 30 days in advance. In that case, we refund any fees already paid for the period after the closure date (for in-app purchases, through the procedures in Article 7).

Article 12 (Disclaimer of warranties)

  1. We do not warrant that the Service suits your particular purpose, that it has the functions, accuracy or usefulness you expect, that it always displays correctly on your device and connection, or that it is provided without interruption.
  2. The guides to the animals were written from general knowledge and have not been reviewed by specialists. We do not warrant that they are complete and accurate.
  3. The Service relies on the services of external providers (Apple, Google, Stripe, Cloudflare and others); changes to or suspension of those services may make all or part of the Service unavailable.
  4. Third-party websites linked from the Service are not under our control, and we do not warrant their contents.

Article 13 (Limitation of liability)

  1. We will compensate users for damage caused by reasons attributable to us, in accordance with this Article.
  2. Our liability for damages arising from our negligence (excluding gross negligence), whether in contract or in tort, is limited to ordinary and direct damages actually incurred by the user and does not include lost profits or other damages arising from special circumstances.
  3. For users who bought a ticket, the damages under the preceding paragraph are capped at the amount the user paid in the transaction that caused the damage.
  4. The preceding two paragraphs do not apply in cases of our wilful misconduct or gross negligence.
  5. The preceding paragraphs do not apply to the extent that the Consumer Contract Act or other laws do not allow our liability to be wholly or partly excluded.
  6. Disputes between users, or between a user and a third party, are to be settled between them, except where we are at fault.

Article 14 (Users’ liability)

If you cause us damage by violating these Terms or misusing the Service, you must compensate us for it.

Article 15 (Exclusion of anti-social forces)

  1. You represent and warrant that you are not, and will not be, a crime syndicate (boryokudan), a member of one, a person who left one less than five years ago, an associate member, a company related to one, a corporate racketeer, a social-movement racketeer, a special intelligence crime group, or any comparable party (together, “anti-social forces”), and that you have no socially reprehensible relationship with anti-social forces.
  2. If we judge that you have violated the preceding paragraph, we may suspend your use of the Service or terminate the contract without prior notice, and we are not liable for any damage this causes you.

Article 16 (Assignment)

  1. You may not assign, or offer as security, your position under these Terms or any rights or obligations under them to a third party without our prior consent.
  2. If we transfer the business of the Service to a third party (by business transfer, company split, incorporation or any other means), we may transfer to the successor our position under these Terms, our rights and obligations under them, and users’ registered and other information, and you consent to this in advance.

Article 17 (Severability)

If any provision of these Terms, or part of one, is held invalid or unenforceable under the Consumer Contract Act or other laws, the remaining provisions, and the remainder of the provision held partly invalid or unenforceable, remain in effect.

Article 18 (Changes to these Terms)

  1. In either of the following cases, we may change these Terms without obtaining each user’s consent, under Article 548-4 of the Civil Code.
    1. The change is in the general interest of users
    2. The change does not go against the purpose of these Terms and is reasonable in light of the need for it, the appropriateness of the changed contents and the other circumstances of the change
  2. Before a change takes effect, we will post on the Service, or notify users of, the fact of the change, the amended Terms and the effective date at least 14 days in advance. A change under item 1 of the preceding paragraph may take effect when posted.
  3. If you use the Service on or after the effective date, you are deemed to have agreed to the changed Terms.

Article 19 (Notices and contact)

  1. We notify users by posting on the Service, by email to a registered address, or by any other means we consider appropriate.
  2. Contact from users to us is by email to the following channel.
    VirtualCross · info@virtual-cross.com · https://virtual-cross.com
Operator details (address and telephone): Notice under the Act on Specified Commercial Transactions

Article 20 (Governing law and jurisdiction)

These Terms are governed by the laws of Japan. The Tokyo District Court has exclusive jurisdiction as the court of first instance over any dispute relating to the Service. However, where the user is a consumer, this Article does not prevent the user from bringing an action in a court competent under the law.

Article 21 (Language)

The Japanese text of these Terms is the authoritative text. The English text is a reference translation; where the two differ, the Japanese text prevails.
